These Terms and Conditions of Sale ("Terms") govern all purchases of products ("Products") from Design MIX Furniture Inc., a California corporation ("Design MIX Furniture Inc.", "Design MIX Home & Garden", "MIX OUTLET", "MIX", "Company", "we", "us", or "our") via our website www.mixfurniture.com (the "Website").
Please read these Terms carefully before placing an order. By ordering or purchasing any Products, you agree to be bound by these Terms, as well as our General Terms of Use, Privacy Policy, and Return Policy. If you do not agree with these Terms, you may not order from the Website or our showrooms.

2. Product Information & Pricing
2.1 Prices may vary between our Website, showroom, and catalog. U.S. pricing is in U.S. Dollars. Prices listed as "Our Price" reflect everyday value. Sale prices are temporary and may change at our discretion.
2.2 Inaccuracy Disclaimer: We may occasionally publish incorrect information (e.g., pricing, sizes, or descriptions). We reserve the right to correct these errors and cancel orders if needed. Contact us immediately if this affects your order.
2.3 Product availability is not guaranteed. We will notify you by email if a product is unavailable and will not process your order or will issue a refund if applicable.
3. Account and Order Information
3.1 You may browse and purchase without registering an account.
3.2 When ordering, you must provide accurate personal and payment information. We may request additional verification to prevent fraud.
4. Placing an Order
4.1 You must be 18 or older to place an order.
4.2 You will have the opportunity to review your order before submitting.
4.3 Submitting your order constitutes an offer to purchase the Products listed.
4.4 An email confirmation ("Order Confirmation") acknowledges your order but does not constitute acceptance.
4.5 You’ll receive a second email ("Shipping Confirmation") once the order is shipped-only the Products listed in that email are part of the final contract.
4.6 If any Product cannot be supplied, we will inform you and issue a refund if applicable.
5. Product Pricing
5.1 Product prices shown on our Website or in showrooms are subject to change. In the event of a pricing error, we will contact you with instructions and options. We are not obligated to honor incorrect prices.
5.2 Price changes do not affect confirmed orders.
6. Payment
6.1 We accept Visa, MasterCard, American Express, Discover, cash, or ACH wire transfer.
6.2 By submitting payment, you authorize us to conduct fraud checks and disclose information to third parties as needed.
6.3 Orders that are not authorized or paid will be canceled.
6.4 Your card will be charged before we ship your order.
7. Delivery
7.1 We aim to deliver by the estimated date in your Shipping Confirmation. Delays may occur due to events beyond our control (see Section 10).

8. Use of Products
8.1 Products are for personal, non-commercial use only. We are not liable for business-related losses. We are not responsible for lack of care, accidents, misuse, exposure to the elements, or any environmental impacts once the Product leaves our showroom.

9.1 Your personal data is used in accordance with our Privacy Policy.
9.2 Text Messages: By providing your phone number, you agree to receive transactional text notifications from Design MIX Furniture regarding your order status, account activities, and other essential service-related updates. Message and data rates may apply. Reply STOP at anytime to opt out
9.3 Special Offers: Promotions, discounts, and "exclusive" labels may vary by location or time and are subject to change without notice.
10. Events Beyond Our Control
10.1 We are not liable for delays or failures caused by events outside our reasonable control (e.g., natural disasters, pandemics, strikes, shipping delays).
10.2 If such events occur:
• We will notify you as soon as possible.
• Performance obligations will be paused until the event ends.
11. General Provisions
11.1 We may transfer our obligations to another entity.
11.2 No third party has rights under these Terms.
11.3 Our failure to enforce a right is not a waiver of that right.
11.4 We reserve the right to cancel or limit orders at our discretion, especially if we suspect resale or fraud.
12. Entire Agreement & Severability
These Terms, together with our General Terms of Use, Privacy Policy, and Return Policy, constitute the entire agreement between you and us. If any part is found invalid, the remaining parts remain in effect.
13. Governing Law
These Terms are governed by the laws of the State of California. Any legal action must be filed in Los Angeles County, California, subject to the arbitration provisions below.
14. Arbitration Agreement & Class Action Waiver
PLEASE READ CAREFULLY. THIS SECTION LIMITS YOUR RIGHTS.
14.1 All disputes will be resolved through binding arbitration in Los Angeles, California via JAMS, except for intellectual property disputes or claims seeking injunctive relief.
14.2 The arbitrator may award any relief a court can, and the decision is final. For more information, visit www.jamsadr.com.
14.3 Disputes may only be resolved individually. Class actions and class arbitrations are not allowed.
14.4 You waive your right to a jury trial.
14.5 Opt-Out Option: You may opt out of arbitration within 30 days of first use by emailing:

15. Updates to These Terms

16. Warranty
16.1 Products are sold as-is unless otherwise stated in writing. Design MIX Furniture Inc. does not offer express warranties unless specifically provided with the Product at the time of purchase.
16.2 Some Products may be made from reclaimed or natural materials and may feature unique imperfections, finishes, and variations in color, grain, or texture. These are considered part of the design and aesthetic and are not covered under warranty.
16.3 To the fullest extent permitted by law, we disclaim all implied warranties, including but not limited to merchantability and fitness for a particular purpose.
16.4 Warranty claims (if applicable) must be submitted in writing with proof of purchase and photos within the warranty period, if provided. Otherwise, no warranty is provided.
17. Return Policy
17.1 ( All Sales are Final ) We do not accept returns, exchanges, or cancellations once an order is placed, except where required by law or explicitly stated in writing by Design MIX Furniture Inc.
17.2 Due to the nature of our products-including vintage, reclaimed, handmade, and custom pieces-variations and imperfections are to be expected and do not qualify for return or refund.
17.3 If a return is approved under exceptional circumstances, it must be authorized in writing by our customer service team. Unauthorized returns will be refused or subject to a restocking fee.
17.4 Approved returns must be unused, in original condition, and returned in original packaging. Return shipping costs are the customer’s responsibility.
17.5 Refunds (if applicable) will be processed to the original form of payment, minus any applicable restocking fees, after inspection for any damages.
